Cambios legales en seguridad y salud en el trabajo y su impacto en las organizaciones
El marco legal en seguridad y salud en el trabajo en el Perú ha experimentado en los últimos
años importantes cambios buscando adaptarse a las circunstancias y siempre orientado a l
prevención de riesgos como principio primigenio. No sólo la pandemia, sino también la
necesidad de regular cada vez más y mejor el trabajo en el Perú, ha motivado que el marco legal
sea un medio que ayude a las organizaciones a adaptarse a un entorno cada vez más complejo,
pero también a responder de manera eficaz a los desafíos que se plantean a las organizaciones.
Por eso, cuando se enseña acerca de los cambios en el marco legal, no sólo se debe ayudar a
conocer cada uno de los requisitos de los instrumentos legales y a establecer la manera más
efectiva de poder implementarlos, atendiendo las necesidades y el contexto de cada empresa,
sino, además, a comprender cómo el marco legal puede contribuir al logro de su estrategia. Por
ejemplo, cuando se aborda los cambios en el artículo 77 del reglamento de la ley 29783 que
establece el DS 002-2020 TR, no sólo ayudamos a que se eviten sanciones por infracción en
materia de seguridad y salud en el trabajo, considerando que las sanciones pueden ser
administrativas (multas, cierre de instalaciones) y penales (el DU 044-2020 así lo posibilita),
también se evita que ocurran eventos de afectación crítica en la dirección estratégica de cada
organización, al prevenir accidentes de manera más efectiva al identificar los factores de riesgo
asociados a los ambientes de trabajo y que, posiblemente, no hayan sido contemplados con
anterioridad.
